4. Prices

5. Payment and delivery

b) Any reproduction, copying, modification, or imitation of the vouchers and/or event tickets, as well as any electronic distribution of the QR code tickets, is expressly prohibited. Kramer Gastronomie reserves the right to take the necessary legal action in the event of misuse.
c) The organizer may refuse admission to the event if multiple printouts, reproductions, copies, or imitations of an event ticket are in circulation and a holder of a printout, copy, or imitation of the respective ticket has already been granted admission to the event. In particular, the organizer is not obliged to verify the identity of the ticket holder with the ticket purchaser and/or to verify the authenticity of the event ticket. If a holder of an event ticket is refused entry for this reason during access control, there is no entitlement to a refund of the purchase price.
7. Returns, refunds, and exchanges; complaints
a) Gift certificates and event tickets cannot be returned or exchanged. An exception to this rule applies in the event of an event being canceled in accordance with 7(b).
b) If an event is postponed, the tickets remain valid. If an event is canceled without replacement, the purchase price of the event tickets will be refunded, provided that a request for a refund is submitted to Kramer Gastronomie within 30 days.
8. Reservations
a) Customers can make reservations at Kramer Gastronomie establishments online, by telephone, or by email. Reservations at Kramer Gastronomie establishments are binding and will be confirmed with a corresponding reservation confirmation (email, text message, etc.) sent to the email address or telephone number provided by the customer. However, a reservation made is binding even without receipt of a corresponding reservation confirmation.
b) Reservations made can be canceled free of charge up to 24 hours before the reservation date via the same reservation channel used for the booking.
c) When making reservations, the customer is obliged to provide all information required during the reservation process completely and correctly. In particular, the customer is obliged to provide and authorize a specific means of payment when making the reservation. Kramer Gastronomie reserves the right to charge the means of payment specified by the customer a fee of CHF 50 per person (no-show fee) in the event of a no-show, late arrival, or last-minute cancellation.
9. Disclaimer
Kramer Gastronomie shall only be liable to the customer for intentional or grossly negligent contractual or non-contractual damage. The corresponding liability is limited to a maximum lump sum of CHF 1,000.00. The burden of proof of fault lies with the customer. Any further liability is excluded.
10. Data protection
The customer’s personal data transmitted to Kramer Gastronomie (hereinafter referred to as customer data) will be processed in accordance with Swiss data protection law. Kramer Gastronomie treats customer data as strictly confidential and uses it exclusively for the purpose of fulfilling the contractual relationship. 12. Severability clause

In the event of the invalidity or nullity of a provision, it shall be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision. The same applies mutatis mutandis in the event that these GTC contain a loophole.
13. Applicable law / place of jurisdiction
a) These GTC and any disputes arising from or in connection with the relationship between Kramer Gastronomie and the customer shall be governed exclusively by Swiss law. The provisions of international private law and the UN Convention on Contracts for the International Sale of Goods (CISG) are expressly excluded.
b) The ordinary courts of Zurich shall have exclusive jurisdiction over all disputes arising from or in connection with these GTC, the legal relationships covered by them, and the contracts concluded via the website. However, Kramer Gastronomie is also entitled to assert its rights at the customer’s domicile or before any other competent authority in the absence of an agreement on the place of jurisdiction.
